Terms of Service

1. Who we are

FundedBy is operated by Riyad Bakhshiyev, Wroclawska 53M, 30-011 Kraków, Poland. You can reach us at hello@fundedby.app.

By using the site you accept these terms. If you do not accept them, do not use the service.

2. What FundedBy does

Founders list a benefit they are willing to give away. Companies pay to sponsor that benefit for a fixed period. During a paid period, people can claim the benefit at no cost.

We are the marketplace, not the provider of the benefit. The founder supplies whatever is being given away, and is responsible for delivering it. We are not a party to that delivery and do not guarantee it.

3. Accounts

• You need an account to list a campaign, sponsor a campaign, or claim a benefit.
• Give accurate information and keep your sign-in secure. You are responsible for activity under your account.
• One person, one account. Creating additional accounts to claim more than your share is grounds for removal.
• You must be old enough to enter a contract where you live, and if you act for a company you must be authorised to do so.

4. Founders

Full detail is in the Founder Agreement. In summary:

• Campaigns are reviewed before going live. We may decline or remove any listing at our discretion.
• You must actually deliver what you advertise, to everyone who validly claims it while a sponsorship is running.
• We deduct a platform fee of 15% from each sponsorship unless a different rate is shown on your campaign.
• You keep ownership of your brand and content, and grant us permission to display it on the site.

5. Sponsors

Full detail is in the Sponsor Agreement. In summary:

• You buy a defined window of placement on a specific campaign, starting at €1.
• Nobody can outbid you during a window you have paid for.
• We do not guarantee any number of views, clicks or claims.
• You are responsible for your brand assets and for the accuracy of what you tell us about your company.

6. Claiming a benefit

• Claims are free. You will never be charged for one.
• A benefit can only be claimed while a sponsor is actively funding it.
• One claim per account per campaign. We apply account-age, verified-email and rate limits to prevent abuse.
• Do not resell, automate or bulk-harvest claims. Doing so may cost you access to the service.
• The benefit comes from the founder. Any support, licence terms or warranty is between you and them.

7. Payments

Payments are processed by Stripe. We never see or store your card details. Prices are in euro and include our fee. Refunds are covered by our Refund Policy.

8. Acceptable use

Do not use FundedBy to list, sponsor or distribute anything unlawful, deceptive, adult, hateful, or infringing. Do not attempt to break, overload or circumvent the service or its limits, and do not scrape it without written permission.

9. Availability

We do not promise the service will be uninterrupted or error-free. We may change, suspend or discontinue features. Where a change materially affects a sponsorship you have already paid for, we will contact you.

10. Liability

Nothing here excludes liability that cannot lawfully be excluded, including for fraud, death or personal injury caused by negligence, or your statutory rights as a consumer.

Subject to that, we are not liable for indirect or consequential loss, lost profits, or loss of goodwill. Our total liability to you for any claim is limited to the amount you paid us in the twelve months before it arose.

We are not responsible for a founder failing to deliver a benefit, or for the quality of any product accessed through the service.

11. Ending your use

You may stop using FundedBy at any time and ask us to delete your account. We may suspend or close an account that breaks these terms. Financial records are retained where the law requires it, even after an account closes.

12. Changes

We may update these terms. The date at the top shows when they last changed. Material changes affecting live sponsorships will be notified by email.

13. Governing law

These terms are governed by the laws applicable at Riyad Bakhshiyev’s registered address, and disputes will be heard by the courts there, unless mandatory consumer law in your own country gives you the right to your local courts.
